Step 1: Call 911 — Always

No matter how minor the accident appears, call 911 and get a police report. Insurance companies and courts give far more weight to documented, official crash reports than to your recollection of what happened. In Texas, you are legally required to report any accident involving injury, death, or property damage exceeding $1,000.  

Step 2: Document Everything at the Scene

If you are physically able, photograph everything before vehicles are moved: all vehicles from multiple angles, skid marks, road conditions, traffic signals, weather, and any visible injuries. Get the names, phone numbers, and insurance information of all drivers and witnesses. These photographs are frequently the most critical evidence in your case.  

Step 3: Seek Medical Care — Even if You Feel Fine

This is the most important step and the one most people skip. Adrenaline masks pain. Soft tissue injuries, whiplash, and traumatic brain injuries frequently do not present symptoms for hours or days after impact. If you delay seeking medical care, the insurance company will argue your injuries were not caused by the accident. Go to the emergency room or urgent care the same day.  

Step 4: Do Not Admit Fault or Give a Recorded Statement

Do not say 'I'm sorry,' 'I didn't see you,' or anything that could be construed as accepting fault — even if you think you might have contributed to the accident. Do not give a recorded statement to any insurance company — including your own — without first speaking to an attorney. Adjusters are trained to use your words against you.
