Texas has one of the highest rates of uninsured drivers in the United States — approximately 1 in 8 drivers on Texas roads carries no auto insurance. If an uninsured driver hits you, your path to compensation is different but not closed. Here's what you need to know.  

Option 1: Your Own UM/UIM Coverage

Uninsured/underinsured motorist (UM/UIM) coverage is an optional addition to your Texas auto policy that covers you when the at-fault driver has no insurance or insufficient insurance. If you carry UM/UIM coverage, you file a claim against your own policy. Despite what you might assume, your own insurer will still dispute the claim and minimize the payout. You need representation even when filing against your own insurance company.  

Option 2: Sue the At-Fault Driver Directly

You can sue an uninsured driver personally. The challenge: if they have no insurance, they likely have limited assets. A judgment against them may be difficult to collect. This option makes sense when the at-fault driver has real assets — property, wages that can be garnished — or when your UM/UIM coverage is inadequate.
